It seems petty, HOWEVER it is possible for things said on forums to effect the outcome of legal procedings. Forum members are taking legal proceedings against the company for their own reasons and I for one think ALL current threads on this should be allowed to die. Freedom of speech, yes, but also thought for the effects of that right to voice your opinions.

I have contacted the solicitors for clarification on this matter. I will await there reply and also ring the solicitors tomorrow to confirm this.

I'd like to see them try and find your full name and address etc so that they can sue you or whatever... Also, isn't it in the forum Ts & Cs that member's opinions aren't that of the forum etc etc etc???

Load of old tosh if you ask me... Look at the address on the solicitor's website - they missed a bit of the address out :(

Now i dont claim to be no legal expert, but im pretty sure that opinion is not illegal

if someone said:
Morspeed are terrible and will not give you what you ordered and will kill your rabbit too!

then they would still be expressing an opinion as they have no fact they're. If they where to find/create acts to back this up purely to harm the business though i can see how that could be slander.

Surely morspeed would realise that people dont just listen to what people say, they go with a majority and then use facts to make their choice, simply dismissing random rants...

I honestly cant believe this. If that was sent from a real solicitor then I really dont think you will have any problems. Judging by the actual 'content' rather than the implied content you wont have any problem.

As far as I am concerned it is the difference between "Company X will destroy your engine. They dont know anything" and "In my opinion you shouldnt use Company X because Y and Z has happened in the past."

Im actually starting to panic, I told my wife not to go to asda today because I think they are more expensive. If asda use those solicitors I might end up doing time with a ten grand fine.

simple solution for morspeed, your obviously getting no custom from this forum now so dont waste the money sueing these people as its pointless and will cost money from sales you wont seem to be getting from here...
I hope the other places like you more then this forum seems too!

dont start legal stuff, just improve your business so people say good things!

I rang six times to buy a flywheel, but after no answer I gave up and went to Mini Spares................ (this is fact not opinion so i can't be sued :( )

Its a county court claim which they are involved in, so both parties will have to provide disclosure/discovery or whatever its called. Its very unlikely that they will use the comments on this forum as it would negatively impact their defence, If I was them, I would concentrate on one case at a time before threatening legal action with no real chance of success.

I can't imagine a reputable solicitor sending you a PM.
They can charge more for a letter... :(

But then, they would need your address.
And they don't and can't have that from the forum.

So on all those forums that I put Classic Mini's are better than the BMW remakes, which is my personal opinion (and a fact) and is agreed by many many people, BMW are going to sue me?

It is just like saying as above oh asda are getting more expensive I won't go there anymore its rubbish, thats my personal opinion which If i could I could back it up with facts (though asda is 25 miles from me).

FREEDOM OF SPEECH! Its an opinion, it may be agreed by some people, maybe not by others, but surely Legal proceedings after saying its a bit rubbish in my opinion... No way!

Its like saying to your mates oh you don't want to go see that film, tis a load of brownies, Odeon or the film producers aren't gonna sue you!

ITS JUST AN OPINION!

Prawn, could I ask you to remove most of your post. With it there I would simply have to remove this topic, without it there is a chance we can talk about the possible legal action against this forum, rather than member's opinions of a certain Midlands company.

I will add that I have had contact from the above solicitors (via a headed letter) last year regarding the court case surrounding Oli's engine.

Whether someone could successfully sue a forum or its members regarding posts. From our (TMF admin) stand point, simply by allowing a post to exist on our servers, and providing a mechanism to that post to exist then it could be seen that TMF are endorsing that opinion. Hence why so far we've erred on the side of caution and removed topics when requested.

So far I don't believe a precedent case has been heard, but who wants to spend the money on legals when the outcome would be so uncertain.
