Sad face. :(

Not long got home from work to find a DVLA clamp on my 10" wheel. Just phoned up the 0845 337 0077 number to enquire about it and was told that number is for payments only, enquiries are another number. They're open 9am-5:30pm and I work 8am-5:45pm. Will have to try and get off work early tomorrow, which will mean less pay for me.

Basically the story is thus:

My tax expired at the end of March this year and so did the MOT. I knew it would fail the MOT so I of course didn't try and put it through one to be eligible to get a tax disc. Unfortunately I don't have a garage or a driveway so the car has to be kept on the road outside my house. Nowhere off-road for me to keep it. A friend of the family offered to put it in his garage so I took it over. That was halfway through April. Some time in August I think it was, the garage owner needed his garage back so I had to bring it back over to mine.

During that period, I was in a minimum-wage/15hr job and couldn't afford to pay the insurance. That ended up getting cancelled due to non-payment. Fast-forward to now and I am in a better paying job and have only just paid off the last insurance and paid for a new insurance policy with someone else. Just last Saturday in fact. The plan was to pay off the old insurance, order new insurance and save up a couple of weeks wages so I can book my car in for an MOT, repair then MOT again and then I can pay for a tax disc. Next week I pay my mother keep so I couldn't do it then but I was going to book it in for Saturday 6th October and drive the car up to Minispeed with a pre-booked MOT appointment.

So I had a sooner-rather-than-later plan to get my car back on the road in early October, but I come home today and I've been clamped so that's thrown that plan waaayyyy out the window.

I know I've been naughty and should have had my car taxed, MOT'd and insured if I was to have it on the road but it's currently SORN'd and insured.

The leaflet that they left says a release fee of £100 has to be paid within 24 hours on production of a valid tax disc, or (or even WITH) a surety fee of £160 if not producing a valid tax disc. Release from the pound 24hrs or more after offence is £200. I could pay the £100 with the amount of money I have now but the £160 will leave me really strapped for cash and I will have to wait 3 weeks (inc. this week) until I can get the Mini back on the road legally. Plus I have nowhere to keep it except outside on the public road in that time.

I'm not expecting sympathy but just words of advice, really. I just don't know what to do. I've hated having the car on the road illegally but I really haven't had much choice. I may have one person that could help out with storage. Will have to see.

well get the clamp off and speak to minispeed, or another mini repairer to store it for a fee

Unfortunately thems the rules.

I'd say get it unclamped and get it taxed for 6 months. 6 months tax will tide you over and that means you spend less and wont have to pay the 160 fee thingy. if i've understood correctly.

I'm unable to tax it because I don't have a valid current MOT certificate. I planned to get that some time after booking it in at Minispeed for 6th October (next Saturday) and leaving it there for them to repair, then getting through a following MOT, driving it home and taxing it online. Sadly this sudden clamping has thrown a spanner in the works.

What are the odds of them letting me keep it where it is until what would now have to be the 13th October because of the £160 release fee (could've got a fair bit of repair work done for that much money)?

Oh yeah and the storage fee at the impound is £21 a day. Where's the lube? :(

[EDIT]I have driven it twice in a not-so-legal state and that was to get it to and from a friend of the family's garage. That was a while ago now. I'm wondering if all this sudden insurance quoting I've been doing has rung alarm bells at the DVLA offices. I've had my car sitting under a car cover for some time now covering both license plates. Only starting it up now and again to keep the engine clear and not seized.

I'll admit that the thought of taking it off had crossed my mind seeing as it is a 10" wheel. :lol: But I don't think that would help my case.

You have no choice other than to scrape the cash together or use a credit card and get it onto some private land.... any private land where it won't be clamped again.

I assume you have no garden at all then, or know anyone with a patch of land mini sized?

just say someone else nicked it ;) you could probably easily get the wheel off :L or just take the hand brake off, lift the front up and get someone tow it somewhere you can store it, then take it off

Nah, everyone I know is a bit strapped for cash but I've just asked for help on my club's forum. If it's £260 within 24 hours then I definitely can't pay that. I don't even have £200 to my name right now and £21 will be used for the rest of the week for commuting on the train. :(

The last thing I want to do is get a payday loan out. Been there before and it's a right bugger to get out of.

Nah no garden sadly. A tiny patch of grass but that's owned by our housing association and they'll need access to that to perform maintenance. I am in a right pickle all of a sudden..

Well I would like to get it taken somewhere off-road. Will have to wait and see what response I get from my club's forum although not a lot of people go on there these days.

I didn't intend on removing it myself anyhoo. I try to live my life lawfully so nothing comes back to bite me in the future. Just this year money's been extremely tight. At least until I got this new job - which after the agency's cut isn't a great deal more than what I was on previously.

What bugs me is that I was only a couple of weeks away from having my car all legal after a few months of it being not-so-legal, and then this happens. God damn. Two bloody weeks.

If you tax it online then they dont check MOT, they cant check MOT so it wont be a problem.

.... of course they check the MOT, all MOT's are now computerised and they check to see if your vehicle is on the MOT database before issuing a tax disc!!

There are obviously much better credit options and if you are in a reasonably paid stable job then you should be eligible for an overdraft, bank loan, credit card etc or failing that if you don't have access to that sort of credit then your local credit union might be able to forward you the cash you need to get you out of this mess.

Aye, IIRC you need to type in the MOT certificate number, which is then backtraced by the DVLA cyber police to see if the MOT certificate is current and valid.
