I've read back. seems he has been to court over a issue with another trader.

 

I dont see anything about taking Jonspeed to court.

I will certainly not consider using Jonspeed, but if you are to have any hope of resolving this issue I think you really need to follow the legal route and ramp up the pressure on them, or and this is not meant to be negative, if you cannot face the prospect of legal action again you need to forget and move on for your own sake.

Most topics of this kind usually silicate a reply from the accused wrong doer. But there has been zero representation from Jonspeed in reply to this topic! That is worrying for two reasons. One they are obviously still trading very healthily which means people are still willing to use them, two they believe they are untouchable and can treat the pion's of the mini community with the obvious contempt we deserve.

You may think that asking for help from this community is not pc or even cheap! I scream back at you your wrong! We are the ant's and individually are voice is ignored but collectively ants can cause damage if not total devastation. It's time we shouted with one voice.

I will not be using Jonspeed to buy from and my company has now blacked Jonspeed as a potential customer.

How about TMF members email Jonspeed, asking where my engine is?  I'm sure after a few hundred they'll realise, and hopefully offer to replace everything that went missing, making me very happy again and proving to us all that they are actually fair.

 

Im not sure this is the right way or the best way. Infact, it reads to me that you cant be bothered to fight your own battle, so want others to assist.

 

I wouldnt have waited this long, I would have got legal advice and submitted a case for it, then presued to recover costs from whichever party was deemed liable.

 

Sorry if that sounds harsh, its just my critical opinion.

 

It is your opinion and you are entitled to it, but just to recap I have tried:

 

A nice phone call followed up by many letters and emails, citizens advice, trading standards, legal action . . . . nothing seems to work.  As a last resort I thought maybe a few emails from TMF members, Jonspeed customers, may make them realise how mistreating customers has a knock on effect.

 

My name is Justin, the engine number is JON143 SBW, the guy I have dealt with at Jonspeed is called Andy and their email is [email protected]

It is down to the individual as to whether or not you want to message them, but believe me anything anyone can do to help I am more than grateful as so far I have lost in excess of £18'000 on this mini, so it's not that I can't be bothered anymore, I just can't afford to continue.

So lets confirm, you have actually submitted a case to a court? Threats of legal action and actually doing it are two different things.

 

I think you might have been your own worst enemy here but not doing this legally as early as possible.

 

If you arent going to follow up the emails with a proper legal action, whats the point? If Jonspeed were to give you money as "goodwill" they would have done so by now.

 

Certainly this topic will suit as a warning to others, but some will still use them as cost is a key factor in anything. If their products are priced competitively, they will still get customers.

 

Like you said its my opinion, but sometimes you need a critical friend in situations like this.

I have sought legal advice and they have informed me of what to do, I have followed their advice and gotten nowhere. So I am left with the choice of taking it further at more cost to myself which I just don't have at the moment, or see where I am in the next few years financially as I have 7 years I think to finalise everything (that's off the top of my head, I have pages of legal stuff that has all the facts)

 

The reason I left it so long is because Jonspeed told me it was all in the hands of their insurance company, also my work means it's very difficult for me to deal with things unless it's via email or written correspondence . . . . hence Jonspeed claiming I'd not received emails.  They initially offered to replace the engine, box and head, but the cost of the ancillaries and other mods would still see me losing a few grand.

I know what you mean Graham, Jonspeed won't give me anything now, they are not answering any correspondence no matter what form it is sent in.

Id be seeking a free hour session with a solicitor.

 

Id state what Ive done and ask what the next course of action is.

 

If you do have 7 years to persue a claim, how do you know JonSpeed will exist in that time?
