common misconception,
the rule is if you hold a straight edge against the wheel the projected line must be inside the arch, there is also an angle stated for this rule, somthing like 60degrees from vertical each way.
I think the law states ... "When viewed from above no tread must be visible."

That's what it is out here in the colonies and has been for a long time, though there have been some over sights over the years.
When the MKI Cooper S was released, it had no flares fitted, but the South Australian Authorities wouldn't registered them, so flares were fitted, initially by the South Australian dealers. When our MKII Copper S (and all subsequent Minis with 4.5" wide wheels or wider) they all had Arch Extensions fitted at the factory.
