Rust is always going to be contentious with MoT's. They can't disassemble or damage the car by testing it, so there'll always be a fine line between when a light tap with a hammer reveals nothing and structural corrosion becomes obvious.

 

You could easily end up chucking good money after bad, but did the seller make any claims in their advert that are now clearly untrue?

The seller merely stated he paid for some welding for the rot in the floor and put it through the mot to sell

The seller might have equally been striped up by an unscrupulous garage who have charged for the work and then lashed it up.

I'm afraid it's very unlikely that you have any comeback on a private sale, even if the seller knew what the car was like it's hard to prove it.
