Insurance Question

Hi all,

 

My wife reversed off of our drive this morning and collided with a parked car (which was parked easily less than 5 metres from opposite a T-junction).

The owner did not answer the front door, so we left a note for them to stop by our house at there earliest convenience.

 

Doing a little searching on the internet - I have found that the vehicle is possibly without MOT - expiring 30/01/2015.

 

 

Could the experts amoungst this area confirm 2 things for me?

 

1. Vehicles with no MOT should not be parked on the road, but suitably off-road?

2. Not having a valid MOT means your insurance is invalid? 

 

Any wisdom people could share would be greatly appreciated

weather the car is legal or not your wife still hit it

 

 the relevant legislation regarding MOT is section 47 of the 1988 RTA , google tells me

As above. If you/wife hit it do the decent thing and just be honest, its up to the insurers to decide to pay out or not. A car does not need mot to be insured anyway as you can drive to and from mot stations/ places of repair.

We have spoken to the owners and dealing with it down whichever route the neighbours decide upon (they shared info that a replacement door on eBay for £40 with us)

 

I was looking for info to ensure my neighbour wasn't going to be caught out as last thing they would want is a damaged car with invalid insurance and therefore worse-off then paying for a body repair outside the insurance companies and informing them there MOT has expired
