That is true,It might just be worn engine mounts/stabilisers allowing the engine to move and knock the selector out of gear. Worth investigating before you rip the box out.
However i would expect it to pop out of more than just 1st..

there is a gearbox on the classified section for sale for 165quid, would it be worth invetsing it that then refurbing mine?

I'd investigate the selector first. The selector should work with just the engine stabiliser above the clutch, that's all that was fitted for several years.

From what your saying it sounds like the gear syncro/bulk rings are worn. As it was said earlier if there is movement on the engine mounts upon acceleration it should hold in gear not come out. Does it happen when you accelerate or when you back off?
Check to see if the rubber bobbins are cracked/broken which holds the selector up underneath the gear stick, this can cause a problem.
Normally if mounts/rubbers are worn or broken you would struggle to get it into gear without it grinding in as it would be out of line to engage gears, does it have this problem or does it normally go into gear smoothly?
Is 1st gear the only problem?
ps, the gearbox is still for sale!!!! (im only trying to offer advise and not generate a sale

I have that problem with my reverse gear which isnt quite as bad as 1st but its still annoying. Would all the advice that has been said occur to reverse aswell?
