Book the car in for its MOT even if you cant get the car in until say wednesday or thursday. So long as the car is booked in within a few days you are ok to drive it. (with in reason)

Yes the law says you can only drive a car without MOT to a pre-booked MOT test, or/and from MOT test centre to place of fix. Within reason as A series spares says if you have a booked test a few days later and have good intention of fixing the problem eg. welding, I'm sure you will be ok.

You can only drive it on the road legally without an MOT if it's to THE NEAREST MOT garage for a pre booked MOT. You cannot drive it for repairs or to a garage beyond the nearest one to where you live, and it must be driven directly to the garage with no detours. I don't think you can actually drive it home legally if it fails, but I'm not sure about that.

You can actually drive without an MOT quite a lot, providing it is actually roadworthy, so if the rust is bad, take it today to avoid any hassle.

Why you need an MOT certificate
It is generally an offence to use on a public road, a vehicle of testable age that doesn’t have a current test certificate, except when:

taking it to a test station for an MOT test booked in advance
bringing it away from a test station after it has failed the MOT test, to a place of repair
taking it to a place, by previous arrangement, where problems that caused the vehicle to fail its MOT test, can be repaired
bringing it away from a place where the problems with the vehicle have been repaired
Even in the above circumstances you may still be prosecuted for driving an unroadworthy vehicle if it doesn’t comply with various regulations affecting its construction and use. Your car insurance may also be invalid.

But none of the above say it's legal to drive the car to a place of repair PRIOR to the MOT taking place, other than taking it to the MOT station to be tested... if the MOT has expired.

Simple thing is to realise that you can get a car MOT'ed upto a month before the MOT expires and still preserve the MOT anniversary date, so it is possible to have a vehicle with 13 months MOT...

There is absolutely no reason to wait until the MOT runs out to get things fixed...?

infact if your car fails an mot, you have not maintained it corretly, because the standard to pass an mot is low in the first place.

Fair point, but what if the cars been off the road for a few years?
I suppose you could say it would have to be sent for an mot, fail due to the rust, then you could drive it home, then to the place of repair, then home, then back to the mot station.
(I did say it would be better to get it to the welders tonight though, then it can be driven to the mot station legally next week)

Ok I retract my last comment, I had not looked into HOWEVER I was quoting a policeman from the Leicestershire constabulary. The actual law can be found on the governments websites. Keep yourself safe and read up on the laws. Quite a few of the comments above are actually bent versions of the law.

I thought I was right as that is what I had been told previously by a senior police officer, so goes to show.

Or the simple answer, move it while it's still legal... :)

Drive it to your mates now, get the rust sorted then leave it there until you drive to the MOT station.
