Midland Wheels, And Just Cracked My Windscreen On A Drive!

It has to be said that this week for me and my Mini has not been the best, I booked the car in for some work on Thursday had a sump guard fitted, engine mounts replaced and a competition engine steady and some Theta 2 up 2 down lamp brackets. I also had some 12x6 wheels to go on courtesy of midland wheels (I know I know you should of bought them from elsewhere I hear you cry but they were a 21st birthday present), anyway I received a phone call from the mini specialist I get to do all the work on my mini to state that surprise surprise the tyres wont fit onto the wheels, (I must admit knowing what I read on the forum I was kind of expecting that outcome!) one of the wheels was damaged trying to get the tyres on the alloys, I rang them to get told that I needed to use and i quote "a brand new tyre machine that has 3 arms that clamp the wheel down and run around the rim, and if i had of used this method of brand new machine I would of not had a problem", 3 of the main tyre fitting companies later (kwik fit, tyre spot and speedline tyres) the tyres would still not go onto the wheels. Therefore I have taken time off work on Tuesday to drive down to Coventry from Newcastle to get the issue sorted! I know many people have had bother getting money back however I have been offered a good discount for them to fit some new tyres which is not the outcome I want but if it comes to it to sort the problem out then so be it! However it does raise the question from me had i been on a motorway with their wheels on the car and i had a blow out and needed a new tyre and say the AA tow me to a garage to fix the matter and none of the main tyre fitting garages above could get a tyre onto the rim the term "not fit for purpose" soon springs to mind, I have read everything on the website T&C's etc and I am under the same impression as a family member that works in law for corporate business' midland wheels are leaving them selves massively open to liability such a problem arise, I have printed the sale of goods act from the internet and its has been annotated with issues that i wish to use hopefully resolving my case i,e.;

2C The term implied by subsection (2) above does not extend to any matter making the quality of goods unsatisfactory—
(a)which is specifically drawn to the buyer’s attention before the contract is made,


I believe that because the wheels did not come with a notice stipulating that a certain type of machine should be used and that it does not mention on the site that a certain type of machine should be used before you click and commit to buy and I was only told over the phone after the problem had arised they are breaking this rule.

(2A)For the purposes of this Act, goods are of satisfactory quality if they meet the standard that a reasonable person would regard as satisfactory, taking account of any description of the goods, the price (if relevant) and all the other relevant circumstances.

(2B)For the purposes of this Act, the quality of goods includes their state and condition and the following (among others) are in appropriate cases aspects of the quality of goods—
(a)fitness for all the purposes for which goods of the kind in question are commonly supplied,
(b)appearance and finish
©freedom from minor defects
(d)safety, and
(e)durability


On both of these grounds I believe that employees from the tyre fitting company's I tried to use can be classed as a reasonable persons, if they cannot get tyres onto wheels then as stipulated in 2B they are not goods of which are commonly supplied.

These are just a few points that have been highlighted that if my matter is not dealt with to a point where I feel happy I will use to argue my case.

To top that off I just went out for a drive in this beautiful weather and some plank floored it past me on a old country road showering my car in stones resulting in quite a considerable chuck and crack in my window. Brilliant!

I hope this post does not seem to come across as arrogant or as a rant I just thought it was worth outlining some of the laws of the sale of goods act regardless of T&C's that a website has!

what particular wheel from MWS has this difficulty of fitting the tyres?

So you've driven from Newcastle, to Coventry to get some tyres fitted and they offered you free fitting?

Wow, now that's customer service!

not yet but thats my plans they offered if i send them down they would do it if i paid over the phone however i don't trust sending them down to be put aside in a factory not knowing who sent them, for me to have paid over the phone prior i just imagine problems with that scenario, plus my mate have just bought an audi 3.0 v6 quattro so taking that for a spin so don't mind the drive down but yeh thats my plans, i always thinks its easier sorting things face to face because its far easier for someone to fob you off over the phone

Wow, I knew MWS weren't the best of wheel quality, but not being able to put the tyres on the rims, a:o

Hope you get a refund, their customer service has a bad reputation on here. If you dont get anywhere with them (alot of people have had trouble with refunds) , remember that Himley is only 2 weeks away, so you could go and "show" them the evidence of the poor quality wheel, aswell as showing people and potential customers near by. Should go down well :teehee: :unsure:

Hope you get a refund, their customer service has a bad reputation on here. If you dont get anywhere with them (alot of people have had trouble with refunds) , remember that Himley is only 2 weeks away, so you could go and "show" them the evidence of the poor quality wheel/blowout, aswell as showing people and potential customers near by. Hope you get it sorted soon, this thread has changed my plans on getting D1's / alleycats , as poor design leading to a blowout is certainly not on! ;)

Also does it mean that every time you need new tyres put on the wheels you have to go back to MWS to get them to fit them?

Well they might, but really who's going to sue for the cost of a set of wheels. It'd cost a fortune and the costs wouldn't be recoverable.

You'd be better of telling them you're rejecting the wheels and if they don't replace/refund you you'll see what trading standards have to say.

I am a solicitor, and unless they admit that they're wheels are useless early (which they won't) then you'll be talking at least £4k worth of legal fees. And thats with a pokey firm like the one I work for! If you're aunt works for one of the big boys (not Sintons is it?) you could probably treble that.

I've got a set of JBW wheels from MWS on mine and haven't had a problem. Both tyre centres I've been to since getting them have had no trouble fitting tyres. However, I know that there are many who have had problems.

I certainly wouldn't drive from Newcastle to Coventry though. I'd tell them you don't believe they merchantable quality and want an exchange/refund.

i have two brand new 6x10 revos which are completely useless due to mws i got speaking to a guy on here about 6 months ago who had exactly the same problem but with 12 sets of wheels he went down to the main office in coventry with a mate and the main man ended up saying he wasnt giving any refunds and it could be sorted out with a fight

they ended up getting there money back finally but that took about 15 blokes at a show really raring up and threatening to really hurt him

I certainly will do, I think it does mean if iI go down the tyres route that I would have to go back to them every time I need a tyre fitting, I wouldn't go down the " I am going the sue route" I just believe with the points outlined trading standards would apply the sale of goods act and see what is going on which I believe they wouldn't have a leg to stand on. I wont be leaving the premises until I feel satisfied with the outcome. Granted there will only be me and my mate there but I will stand strong and present my research if needed which I believe if they take the time to read it will be far easier for them to just give me my money back and that be the end of it because I will go down the trading standards route.

Not Sintons mate but one of equal size, I wouldn't go down the route of suing no point for the cost implications like you say, however taking that sort of research and understading to trading standards I think MWS wouldn't have a leg to stand of it they got involved. I would just like them to swap the damaged wheel and some decent tyres at cost price and I would consider it sorted. In regards to driving down it would cost me 34 pound to send them or drive down for around 45 pound I would rather do that and sort it in 1 day rather than send back try and sort it over the phone etc etc

I will be playing hard ball and like I say I will be taking the full sale of goods act down all highlighted with various points all relating to the issue in hand.
