You missed a lot. My sister wanted me to move it so I took it to my gf's house in Bournemouth. The day I took it there, the can broke down and lots of people parked up meant I had to leave it in the space for another flat. I left a note saying they could use the space for my gf's flat.

It turns out the property management company told the landlord that there can't be a car with no tax or MOT on the property so it had to move. Gf moved it up the side of her room and was still not good enough. So I went back and moved it - her friend said we could keep it there. It was only going to be one week - it was on eBay.

On Thursday I was informed it was stolen, gf thn discovered a company called FSW Security took it to Poole, apparently at the request of SPL, the management company for that block (there are 9 car park spaces outside). FSW inform me a permit is required to park there and that they were asked to move it. I didn't see any signs to say clamping was in force and my gf's friend didn't say anything about a permit.

I am going to find out of SPL did ask them, and of they didn't, as far as I'm concerned it's theft and will press charges. If it turns out my gf's friend didn't know all the rules etc and there are in fact signs up, then there isn't too much I can do about it.

The company want 455 (going up by 20 per day) to release it. I just can't afford that.

I've told the guy on eBay of I get it back that he can have it for his winning bid. He was very understanding.

FSW apparently have a bit of a reputation for just taking cars etc. I know I shouldn't have parked there if it is a clamping zone and I needed a permit, but there was no notice informing anyone the car would be removed and I intend to follow this all the way to the end.

A nightmare start to finish.

Yes indeed. And the really **** bit is if I dont get it back the poor mini will be crushed. :( I really don't want to see this happen. My first letter wi be informing them of my intent to press charges and not to take any action with regards to the car until the matter is sorted.

Might want to check in at your local police station before you send them a letter to check if theres a valid case from the police's pont of view for theft, cause the act of theft is "dishonestly appropriating property belonging to another with the intention to permanently deprive" and there doesnt seem like a dishonest act (as its their job even if they are bastards), and theres no intention to permanently deprive cause they are giving you the chance to retreive the car if you pay the fine....

I reckon you may have a case for TWOC though (taking without owners consent), so thats atleast something to use?
Although you have to prove: that it was without the owners consent or another lawful authorities consent, they actually took it, for their or another persons use...

The ''intention to permanently deprive'' is the bit you'll come unstuck on as they'll give it back to you for a small fortune. However, if there are no signs and they didn't give your fair warning they shouldn't have towed it.
