Help Me :( Cat Is Appearently A Cat B Write Off

ok long story but ill make it short

the car has been in my dads name from 8/oct/08

we recived the car with mot cert's from england and got previous mot hisorty nothing out of the ordinary

and we have had 3 mot's in northern ireland all passed

has been insure threw this company before "axa" and post office and so on

now they tell us that the mini is now a write off as it had an accedent back in 16/12/2003 Category B - The body shell should have been crushed, vehicle should not be on the road.

and they have only discovered this now!

that has been 9 years that the car as "appearntly" been unroad worthy. what the hell have they been playing at?

the car has been worked at guys who are specialists in minis well over 30 years, but we couldnt take it to them for an engineers report as the insurance guy basicaly said they might do us a favour, the guys where disgused about that

i and my dad or at are wits ends

the car is stright, sub frames are soild the floor looks to be original, every window except the passangers which has a different no in it, has the reg etched into the glass! it has little rust in the places where you would expect there to be rust. and the vin numbers all match

i just dont know, are they saying that the MOT is pointless as "MOT test checks that vehicles meet road safety and environmental standards"

if this really is a cat b which it is saying, how the heck has it passed 3 mot in northern ireland?? and northern ireland mots are more stricter that english ones and has been insured 4 times !!

now the insureance people got an enginner out but he seemed to be a *******, we was checking panel gaps in the door and the bonnet, saying there was a good bit of filler in the drivers doors, show me a mini that is used everyday and doesnt have filler, and also, he complained about the fiberglass wheel arch as it has been repaired but still has a crack in it.

i just dont know anymore, i can see a decent mini well the shell anyways having to be scraped

im so fumming at all this :(

hate to say it - sounds like its a ringer , with details of a crushed car

would they have been looking for a car that was certified crushed ?

sounds like 2 databases have been put together and your details are on both

when did the a b c d insurance category's come in to force ?

hopefully they and me are wrong

From i very quick read of this and not being up on irish rules etc but just because the car has passed an MOT doesn't mean that in a previous life the car wasn't written off ie CAT B.

The MOT tester only checks the car is roadworthy and that the vin on the computer matches the car presented for the test.

Somebody in the past has obviously repaired it or reshelled it after the CAT B

Don't know how you could get around this as the DVLA have written it off and so it shouldnt be on the road, you might get away with a "Q" plate

Not sure what advise to give, but if I were you I would contact the NI equivalent to the DVLA direct.

If it was indeed a Cat B the savage company should have issued them with a Notification of Destruction. Hopefully there might just be a mixup somewhere as it has only just been noticed, they do happen.

Just reading about Category's - they may be a bit fuzzy as the whole thing appears to be voluntary

so it may be legal to put it back on the road - after a VIC check

hope it works out ok for you - a nice Mini

have you any details of a VIC check in the paper work ?

Personally I am leaning more towards wires crossed somewhere because if this had been in a cat b accident firstly when MOT'd the details go onto the dvla system which would have rung bells their end as it shouldn't even be on the road, and insurance companies always do a check on the reg plates prior to insuring a car as they hate insuring risks. It is worth ringing and checking some brain dead bimbo just didn't hit the wrong key and entered your details wrongly. You could also ring up another insurance firm and it would be interesting to see what they say.
