Long story short, Someone (I'll call them bob to make it easier)I know was applying for their first provisional license, they thought that they were going through the DVLA but it ended up being a third party website, they charged £90 and said that they would send an email when it is being processed, bob emailed them the day after to cancel so he could have a full refund and go through gov.uk. First off they said that the order has already been processed and they cannot refund the money, even though no email was sent through stating that it was, another email was sent and they agreed to refund all of the money within 10 days, bob has emailed them twice regarding when the refund will be showing in the bank and they haven't responded to the emails, could they be taken to court ?

I would tell 'Bob' to contact his bank first as they may be able to sort something. This was on the telly recently as a scam for driving licences and passports.

I agree. Banks can request the money back from them if they can't stop the transaction. Usually they might put Bob through to the fraud department where he can explain the situation, they will ask questions of why he wants the money back, has he received the goods and other questions, they then request the money back off the website or company, of which the company have so many days to reject the claim.
