What causes oil to leak out when it is at the full / max mark? Or what seal is it in contact with when it is sitting at the max mark?
When it sits in the middle between min and max it seems fine and doesn't loose much

Might be the crank/timing cover seal if it this only occurs when full. The best method would to find the leak as Cal stated.

Dipstick seal? The higher up the oil is the more likely it is to flick out

Hmmm not sure about that - crank shouldn't be anywhere near the oil and there isn't much else that will splash oil up.

It could be that the crankcase breathers are blocked, and so over pressurising the sump/ gearbox when the air volume is less
due to the oil being at max.
