lost a wheelbearing, the RAC nearly lost us the van

now I know your minis aren't quite the same weight as me Mk2 luton, but as as it looks like either operator error, or equipment failure, so this could happen to you! Just as disturbing, the RAC have not been at all forthcoming with acceptance of liability. This means we probably will have to go to court to get our repair costs back.

how did it do that? Something must have broken on the recovery truck?

Wont it be c&s you need to persue since its their truck even if they were acting on behalf of the rac.

No, contractually it's down to the RAC. I have had no contact with C&S. I called the RAC, so it's their responsibility.

What on earth failed on the truck?

How old is that tranny also?

Was the van particularly heavy on that side or anything? I agree, your contract is with the RAC and it is down the them to settle the issue with you (although not sure what exactly, granted it was close but if nothing was damaged further, it's more likely to be a gesture of goodwill than anything else). If they then need to, they would seek compensation in whatever form from their sub-contractor. 

 

I had an issue once with a broken down Luton carrying a mini, being carried on a transporter truck!

She's an 84, 30 in December this year. The front and rear N/S springs are bent, a crossmember is torn, and the locating lugs sheered off the axle, allowing the axle to move diagonally along the springs. Oh and we lost a tank of petrol! So a fair bit of damage.

That is fair enough and absolutely the RAC will have to cough up for that. I don't know why they are even bothering to defend it. They must have been through things like this enough time before to realise its not in their interest to mess around, just get it sorted and claim back from the sub-con. I would of have thought they have enough repair guys to be able to do the work and it not cost that much.

So what went wrong? It looks like the recovery sliding bed failed?

I understand your anger but if you end up having to persue this through the court then things like this thread won't help. You can't assert that the RAC were negligent here, it's not their truck and they don't maintain it. I agree that obviously your contract is with them and the liability is theirs, but there's a difference between liability and culpability. I think you need to calm down a bit. Your van broke, their truck broke. Is it your fault that your van broke when it did? So is it their fault that their truck did? Publishing attacks on the RAC like this won't put them in the frame of mind to want to settle, or even help you out.

I think a few others have asked; but what was in the van? Was it full or loaded to one side?

The van was very lightly loaded, mostly on the floor. What was in it came out of a SWB so it wouldn't even been at gross weight.
