If a warning lamp fails to illuminate or fails to go out I thought that was a failure?

I think the "new" UK MOT rules are a bit vague, certainlig on modern cars, the Engine Management Light (EML on will be a failure as will
-
Electronic stability control
-
Safety restraint systems so seatbelts
-
Anti-lock braking systems
-
Tyre pressure monitoring sensors
but, my local MOT station now has a rule that any dashboard light that is on, and should not be on, will be a failure.
Thats probably harsh and the "wrong" interpretation of the rules, but lots of MOT "faults" are down to the mechanics discretion, and remember the mechanic has the licence, not the garage, so its very much open to his / her interpretation.
I also know mechanics who will view a light on that shouldnt be on, as an owner that cant be bothered to look after his car, so that makes him look even harder for "other" faults. Its a bit like presenting a dirty car for an MOT. If you cant be bothered to wash it, have you bothered to maintain it,, is his view.
Also at £50 or so a go, I would fix the "fault" first just to cover my own a....

It might be if it's a testable warning warning lamp, but not all warning lamps are testable items.

This is not an MOT fail but maybe a reason for a Refusal to Test in which case the individual tester should issue a CT30 giving the reasons.
But why not fix it ?.

test only covers safety or emission control items. question is would you want to run with lamp on? unless you have a gauge also in which case diconnect the sensor!

The new switch arrives tomorrow so will fit it at the weekend.
