Insurance Nightmare...

car was written off in january of this year... had some problems with them not wanting to repair it.. and so they wrote the car off..
my insurance company then suddnely came up with a 'no modifications policy' despite having all the modifications on the mini declared.
it was then decided that i would have the value of the car in standard form sent from my insurance company.
the remainder would come from churchill who was the other persons insurance company..
they are being very tactical about not paying up, wont send letters.. and i can never seem to actually get through to the correct department. Ive now been on hold again for 30 mins.
What can i do??

Insurance companies are are regulated by the FSA (Financial Servicew Authority)

they would be unable to help me this time around.
I have now spoken to Anita at Churchill who informs me that they will not pay out since it should have been included in the amount paid to my insurance company.
any ideas now?
the third party reversed into my car, whilst it was stationary whilst i was in the house in a cul-de-sac. he admitted liability straight away no questions asked.
my insurance company sent me a letter saying they would pay out for my car in standard form.. but would not pay for the modifications since they have a 'no modifications policy' which i wasnt aware about until i had to inform them of the accident.
The modifications; i made sure that i had declared them, and they came through on my documents. When i spoke to them, they said they weren't listed. We argued and i send them proof of my documents. Regardless the third party still hit my car, it could have been a washing machine and the insurance company would still have to pay out.
so the ombudsman wont help, trading standards do we think?

surely that is like a contract between you and them and they have to pay it out?

you have proof from them saying your mods were insured - failing that you could insist on having all of the modified parts off of the vehicle (which you could then re-use or sell).
might have to threaten with a solicitor as they are now not honouring a contract set up between yourselves and the insurer.
whether the third party pays your insurer or not is not your problem. if you are fully comp then you shoul dbe paid out the agreed figure and they then chase the 3rd party.
sounds like a whole heap of cow poo they are trying to feed you. don't accept any cheques or settlements till you are happy though mate, as that constitutes acceptance of no further payout.

Ring them up and ask for a copy of your call - if you have declared your modifactions over the phone and they have not informed you of their ' no modifcations rule' then they don't have a leg to stand on!.
Also gather up as many bills/receipts/photos etc of your vehicle, dated as close as possible to the accident to help prove the value of your vehicle.
If you do not have an agreed value on your policy then they will only offer you scrap value - but it is still worth trying to prove it is worth more.

Ring them up and ask for a copy of your call - if you have declared your modifactions over the phone and they have not informed you of their ' no modifcations rule' then they don't have a leg to stand on!.
Also gather up as many bills/receipts/photos etc of your vehicle, dated as close as possible to the accident to help prove the value of your vehicle.
If you do not have an agreed value on your policy then they will only offer you scrap value - but it is still worth trying to prove it is worth more.

Yeah it is a modified city.
Yeah they were recieved yesterday, will be filling out the forms and gettting them off in the post asap.
