I'm not sure about legal protection and all that jazz, i'l ask when i ring up my insurance next.
Well progress! I went to work and picked my boss up and he came and had a look and priced it all up. The assessor that came gave him a ring after and they came to an agreement on the price of work etc. So it's is not going to be written off and the work has been authorised, it's going to get picked up soon and work will commence. It will be a really good job too, everything i have seen or worked on since i have started working there has been excellent work. Can't wait

what will it be classed as by the insurance for the accident?

Cars only get categorised (Cat C) if they are actually written off by the insurance company don't they?
Glad you're getting a good result out of this. I had an accident with my clio, somehow my the insurance company figured it was going to cost £2500 to fix the car, but paid me £3000. When I questioned it and said why don't you just fix my car as its cheaper, they're response was the car had already been declared a write off (only cat d, and they didn't even tell me!) so it was too late. End of. Insurance companies are useless

I think the car would be classed as accident damaged on HPI checks, but not categorised e.g Cat C repaired.

No cat c needs a vic check once repaired and cat d requires some paperwork too. Basically it is too much hassle to write it off if it can be fixed fairly easy. He said they have started to try to repair lots more cars than written off these days.

They are picking the mini up this afternoon and I am getting a hire car so that's a relief.
if they decide to write it off you will never see the car again and will have no chanced to get it back
Thats not quite true. You can buy it back for the salvage value from the claim. IMO ( working in accident management ) the car will £100% get written off. Once the car is assessed, demand it is returned to your possesion. You may have to pay the storage costs direct to the storage yard and claim it back from the tpi. You can even stipulate where the car gets repaired. However, as stated previously, be prepared for a long battle. You could always go to a claims company if you so wish. If your insurance company provided you with a hire car, usually this is only for 2 weeks. A claims compant will keep you in hire until the claim is settled either by way of the car being repaired or a cheque for the value of the car, less the salavage value being sent to you.'

well when i was speaking to the insurance company they told me it would cost 1800 to repair and they paid me 3000 for a write off. i went to my local garage and paid 580. so with the money they gave me for the write off i paid for insurance, tax, repairs and a new iphone :) insurance companies are stupid.

Not really, you have just spent the difference beween the value of your car being a category write off or not.

Writing off means the insurers aren't responsible for the repairs, so it's their preference for older cars to avoid complications and ongoing costs. They don't take "post accident value" into account really, your losses are the pre-accident value less the salvage value (to them) if you keep the car. It's up to you if you use the pay out to put your car back on the road, so taking the loss in value is your choice. Not that it really effects Mini's - we've got rust to worry about instead!

its a shame you didnt record his reaction or as he said ill cal lthe police, you should of said ye ok ill do it for you as you crossed over my path so F you!
