But if they have no record of you then presumably they have no record of the deposit, so why would they give you money they don't know you gave them? :(


I have a bank statement with the amount going to said management company so this should cover this problem, either way the money i could save if i dnt have to pay 6 months rent will far outweigh the deposit, so if i dnt get it back its no big deal

Shifty - it says

"the term shall be from and including 01/09/2009 to 01/08/10"
"To end the tenancy periodically 'I' must give one months written notice must expire before a rent due date"

What does periodically mean?


I thought you said you had no record of the agreement.
Why have you decided to move out before the agreed term ends ? Is the management company not doing what they should , or have you just changed your mind ?

A contract exists where both parties accept that it exists, whether you have signed anything or not. Simply puy, a verbal contract is binding and by moving into the house and accepting that you live there under the terms of the lease you accept that such a lease exists. If you challenge the existence of the lease then they probably won't have to return your deposit even if you can provide proof that you paid it. The clause that makes it returnable will be in the agreement that you claim doesn't exist.
