Hi all,

I am after some advice before launching at this company - they seem to offer a good service but when pressed they turn rather vague and dis-interested.

The story / situation:

My uncle came across some lockhead 4 pots on a Ford Capri and we are going to fit them to the Mk1 Escort we are building. The pistons had seen better days so we decided to replace with stainless steel ones.

A scout around found Bigg Red Ltd as one of the only suppliers - so we duely ordered them at a hefty price of £100!!

On arrival we installed them in the calipers, we used the original seals as they were not very old, and had been checked by my uncle (a mechanic for some 30+ years). The pistons were very tight and my uncle was concerned they may bind in time.

I contacted Bigg Red who immediately said "they are supposed to be a tight fit, we sell a lot of these and have never had a problem". So i explained the situation and my uncles experience, to which the owner, John, then agreed to fit the pistons and check they were not too tight. We micrometer'd the pistons and they were approx 0.5mm larger than the originals.
I also asked that they be handle with care as they had already been powdercoated ready to fit. (this bit is where the issue arises)

Anyway I sent the calipers to him last week via DHL / Parcel2Go.com.

I had to chase him to see what was going on - then get a voicemail saying "your calipers are all done and ready to be collected, they are fine there is nothing wrong with the fit."
So i arrange for a DHL / Parcel2Go.co to collect them.

The calipers arrived at my work yesterday so I went down and checked them. When i opened the box, the calipers had been loosely wrapped in corregated card (I had sent them individually wrapped in bubblewarp and the box packed with shredded paper - from a minispares delivery i had). So firstly I was annoyed at the poor way they had been packaged.

Anyway I will let the following photos do the talking:

Posted Image Posted Image Posted Image Posted Image Posted Image Posted Image

As you can see the coating has been damaged quite badly, and all over the calipers.

They have also fitted the outer seal and metal ring which cannot be fitted by hand, as Bigg Red are claiming.

I feel I have every right to continue to insist they put right the damage they have caused, as the photos suggest / prove they have used G clamps (or similar) to fit the outer seals and in doing so have ripped the powder coating off of the outer faces.

What are you suggestions guys and girls as the owner is refusing point blank they have done it and that when he packed the calipers up they were "in the same condition as they arrived, I did not check them in minute detail as I had no reason to" and basically telling me to do one.

I am offended at the guys arrogance and downright lack of customer service. I appreciate he fitted the pistons and seals FOC but he offered to do that based on his confidence in the pistons being correct.

Cheers

Wilson

Not sure whether I have grounds as I have not paid them for a service, but I think that may be my next port of call as the guy is simply ignoring my emails now and I can't phone as I'm at work.

It's a shame because the guy seemed genuine but maybe it is a front until things go wrong?

If you haven't paid them for a service, they have done it FOC, then I don't see that you have a legal leg to stand on as it was all at your own risk & without contract.

Sorry. Bummer.

I need to get it sorted as my uncle is going to do his crunch when he finds out - and will want to throw a lot of F's and Geoff's at the bloke.

Which obviously won't improve the situation any

I appreciate that Ju - but would it not be similar if you sent your car in to have the brakes checked - only for them to scuff your alloys by dropping them?

Duty of care springs to mind?

It's not something you can prosecute them for, though, is it?

I have every sympathy. You trusted them with your property & they damaged it, but if you have no proof & no contract has been broken, what can you do?

Make a lot of fuss and shame the guy into at least admitting he caused the damage.

I know it is a losing battle but i'm a stubborn person when it comes to having my trust misplaced - grrr lol!

Unfortunately I think JuJu is correct. It's a bitter pill but you have not entered any form of 'Contract' with this guy due to you not paying for the service.

Only thing you can do is remind him that companies like his live on reputation, and it's not hard to spread bad experiences on this new fancy internet I've heard so much about.

Sorry

Well the car will be a feature car in a few mags (already been agreed) so I could mention that it would go in the write up about doing things twice due to companys messing up

suprised at that - Ive had 4 sets of calipers from him without fault. mind you - none of mine had the powder coat / heavy paint finish.

I think most have viewed and not commented because thyey dont want to give you the bad news that the damage I would say is inevitable, as they would have been clamped into a jig to do the work - in fairness it was bound to happen.

And to inject further misery, I dont see what trading standards or C/A will be able to do to help you, unless you have a signed agreement to the specification of the works to be carried out, including packaging specifications ( what you have described is how all his calipers are packaged - based upons the ones I have bought in bright zinc finish )......and you can demonstrate that the finished result varies from that specification, you really dont have a leg to stand on.

All you appear to have is a simple request and instruction to carry out works, with no definition or specification - and at no cost for the fitting, so you have no grounds for remittance or refund on that aspect it would appear.

I'd have expected him to take a bit more care, or even to have advised you that some damage would occur - it was inevitable and bound to happen - but then I guess if he's busy, and doing the fitting for free your not going to get 'Bentley' levels of service and care.

I know that doesnt help much - sorry

So basically despite me asking them to be careful, I have got to accept the damage?

The other aspect that is really bugging me is he is strongly denying any clamps were used and that everything was done by hand- so outright lying to me? Is that not part of the issue??

If they had come to me or my uncles garage in the condition, some form of padding - even some rag - would have been used to try and protect them.

to be honest it seems he has taken a "just get it done" attitude i in which case why not offer e full refund on the pistons as opposed to offering a free fitting service??

The way he is ignoring my emails and failing to call me to discuss this further points to the fact he does not want to deal with his mistake.

Sorry for the rant but if you damage someones stuff - have the balls to own up!

You can rant all you like, Mr W, and I know you will...

In essence, you asked him to do you a favour, he did you a favour, but he also buggered bits up at the same time.

You can go & point & shout at him if it will make you feel any better, but he's not obliged to respond in anyway (even an apology!).

That's pretty much all you can do.
