Failed Mot Retest. Are They Alowed?

Basicly my car failed its mot, I took it back earlyer today and they done a retest. However in the retest they tested things that didnt fail the original test and failed them. Are they alowed to fail additional items then they did in the original test? I don't think its fair that they passed it 1st time then failed it 7 days and 20miles later. Are they trying to make money thinking I'm going to go back to them and pay for another test?

Also am i able to drive the car to a rolling road with no tax or mot. I need the carb setting up for it to pass the mot, If im not alowed to drive it i cant win :D

Depends what it failed for the first time, some failures attract a partial retest, some need a full test. You shouldn't need a rolling road tune just to get it through the MOT, any mobile mechanic should be able to get it close enough for that at home but you are allowed to take the car for repairs as long as it's booked at the garage and your insurer accepts it. Although I think you have to go directly there from the MOT station technically. The rules are on the back of the form I believe.

I went back for a partial retest. They didnt check everything again just some bits they did and failed them

Its not actualy a mini but its fitted with a twinchoke 38dgas webber and failed the emissions badly. I can set up carbs pretty well on my own but dont have equiptment to check the emissions. it would be easyer to take it straight to a rolling road to i know its perfect

Well what's to be tested in a partial retest is written on a BIG poster in the viewing area at the MOT station. You could have looked at it while you were there! Check VOSAs website.

Easier doesn't always mean legal though!

What specifically? If it's something that would have been evident at the first test then maybe you should get on to VOSA.

Ill have a look now.

I know it doesnt, thats why i was asking if it was legal, It would be the closest garage with the correct tools (rolling road) but its still quite far away.

fuel pump insecure
cv joint gaiter insecurly mounted
front brakes imbalenced
parking brake eficiency below requirements
both rear brake little or no effort
front and rear brake pipes inadequately clipped

I know its stuff thats easy to fix but thats not the point. I have to pay for another test because they didnt see it in the original test

side lights wrong colour (yellow which i thought you were alowed?)
exhaust emissions
exhaust noise
front brake hoses with insufisient room to move (didnt change anything about them for retest, Looked fine to me)
front brake pipe leaking
track rod end locking device
front balljoint
front wheel bearing
rear springs cut
stearing wheel in condition that hampers control
brake pedal spongey (were fine after a drive home)

I know but why didnt they say 1st time. then i would of got them fixed and wouldnt have to pay for another test

Presumable they will retest the brakes completeley under the heading spongey brake pedal!!!!

fair point but would brake go from almost perfect to nothing in 20 miles? I beleve the brakes are actualy better now then they were the 1st time
