Even if it isn't right to do that, when it comes to brakes there's no argument that they need doing, it's safety. Somethings can be turned a blind eye to if you know the right people but when it comes to brakes, suspension and general safety stuff then if it isn't right It shouldn't be on the road.

front brake hoses with insufisient room to move (didnt change anything about them for retest, Looked fine to me) (To the MOT tester though, it obviously didnt look fine...)
front brake pipe leaking (Because of this, he wouldnt have carried out a brake efficiency test which is why the brake imbalance and efficiencies werent spotted and failed on the retest)
track rod end locking device
front balljoint
front wheel bearing (Replacing either the balljoiint/wheelbearing could easilyt have diturbed your CV gaitor, causing the clip to come adrift)
brake pedal spongey (were fine after a drive home) (You had a brake pipe leaking!)

fuel pump insecure
front and rear brake pipes inadequately clipped
These are the only 2 things that really have no reason for not being spotted, though could have easily happened in 7 days / 20 miles in VOSA's eyes

Im sure the guy knows that what it failed on both times are all valid mot fails!!

What he is asking is shouldnt the MOT tester have picked these up first time and yes I believe he isnt doing his job correctly by missing them 1st time then picking them up on re-test....

I would be asking for the re-test and subsiquent retest to be free and or reporting him to VOSA for missing these items first time...

Who knows if he missed them first time and there was no failures he could have just sent you on your way with dodgy brakes!! I know i wouldnt want to be driving on the roads with the thoughts of someone behind me with a dodgy MOT...
