Also am i able to drive the car to a rolling road with no tax or mot. I need the carb setting up for it to pass the mot, If im not alowed to drive it i cant win

Well what's to be tested in a partial retest is written on a BIG poster in the viewing area at the MOT station. You could have looked at it while you were there! Check VOSAs website.
Easier doesn't always mean legal though!

What specifically? If it's something that would have been evident at the first test then maybe you should get on to VOSA.

All valid MOT failures, don't think you will have a leg to stand on with VOSA

They may have been OK 20 miles earlier or the MOT inspector was in.
Presumable they will retest the brakes completeley under the heading spongey brake pedal!!!!

fair point but would brake go from almost perfect to nothing in 20 miles? I beleve the brakes are actualy better now then they were the 1st time
