Someone Hit My Mini Whilst Parked Up

so I'm at work, mate comes running into my office saying some guys just bumped your car, I've run out to go see whats happened and as I walk next to my car the car infront pulls off. My mate goes it was him so we both stare him down and he stop and says "yeh that was me". Its scratched the arch and there was blue paint (from his car) all over the arch and wheel. My mate said it probably wont polish out to which he said in a stern voice "why not?"

Well anyway he came up to take some pics of the damage and started taking a picture of my tax disc so I thought whisky tango foxtrot? Comes into the store calls me down and says "you are not displaying a correct tax disc I don't have to give you anything" My tax is due 30/04/12 which is what I said to him. Anyway as he was leaving he says well I will be contacting my insurance company and you have to provide 3 quotes for repairs.

My manager said if he's reporting to his insurance company you might want to give yours the heads up as well, but after about 2 hours or so when I managed to call mine they said nothing had come down from the other guys insurance so he hadn't reported anything yet.

Never been in a bump before is there anything else I'm meant to do? I would have wanted to settle outside of insurance however due to the pillock questioning my tax I think he's hoping I'm not insured.

I hope you took his licence plate & insurance details etc? If your insurance company doesn't hear from his then give them all his details & get them to chase him.

Let insurance know he was trying to leave the scene of an accident when u manage to stop him!
Sounds like he isn't insured.

Type his plate in and it will tell u if it's insured or not :)

If you do find that he is uninsured you'll be lucky to get anything from him, but you should report the accident to the Police.

You don't need to go through your insurance company if you don't want to. You can always manage the claim yourself. Get two or three quotes for the repair (and a hire car if you need one while yours is being repaired) and send copies of them to him, instructing him to either pay himself or pass them on to his insurers immediately.

His insurers are probably not going to contact you and invite you to claim as he's clearly at fault, although they may make contact and offer to handle the repair for you. You might prefer this as they will deal with the body shop and get you a courtesy car and pay for it all direct.

Whatever happens take none of his nonsense, sounds like he's trying to intimidate you into not claiming.

I had this once when i came out of uni in the past, but obviously they didnt leave there details..grrr

Sadly thats the stupid american culture this countrys adopting.

Clearly, youve never been on the recieving end of a court summonce and experienced the emotional and mental stress it causes.

For what? Accidents are only reportable if someone was injured, third party (including public) property damage occurred, or someone left the scene or otherwise failed to exchange details. A car park shunt is not a Police matter and is just a waste of their time.

You've done all you need to for now and reported to your insurer. If they don't hear from his insurer in a few days, then start to chase it up.

Just ignore all the texts and calls you will now get from ambulance chasers. Including one appearing to offer you a courtesy car. These people pray on accident victims. Only deal with your insurer directly, or people they have directly told you they want you to deal with. Get quotes only once you know that's how they want to proceed.

Last time I checked driving without insurance was a criminal offence and should be reported to the police.

That's OK. I just re-read my original post and it is open to ambiguity. I think we'd both agree that if he turns out to be uninsured it should be reported to the Police, if he is insured then, as you say, there's no point.

Your insurance company will be in touch in the next 48 hours advisin u where to take your car for repair as they will have a contract with a local garage!
Now as it wasn't your fault you should get a like for like courtesy car.

U can take your car to what ever garage u want if u don't want it to go where they advise but if u don't then u won't get the courtesy car. That is the only gun over a barrel they have in you!

You do not need to speak to anybody else apart from you insurance, this is what the legal fees included with insurance are for.
You will receive a letter off your insurance asking u to explain what happened. Fill that in and send back

Last time I checked driving without insurance was a criminal offence and should be reported to the police.

And at the moment, there is absolutely no indication that he is driving without insurance. Everyone is so quick to jump to conclusions. You cannot assume that the guy does not have insurance just because he was going to drive off.

Dan was right in what he said - this doesn't need reporting to the police unless something further develops - like he is confirmed as having no insurance.

Emotional and mental stress of a court summons? I am sorry for causing offence if I do (samsfern - this is not directed at you, but more a general observation), but jesus some people need to get a grip. People can't seem to cope with anything nowadays. This country is fast becoming a nation of emotional wimps.

All of this assumes that the OP has fully comp insurance with legal expenses and courtesy car cover; on many policies these are extras. He may only have Third Party cover and not have any extras. He may also have a large insurance policy excess (which may be bigger than the cost of the repair). In either of these cases he would have to pay for the repair (or his policy excess) himself. He has already said he would prefer to deal with it outside of his insurers and it sounds like he hasn't initiated a claim with them yet.
