realistically, he is not really going to sue the man for everything he has got. It was just a figure of speech. But i do also believe if the man is not owning up to his own misdemeanor, then he should rightly be taken to court to pay for the damage he has caused. Damaging someone's pride and joy causes mental and emotional stress as well to the owner when the person is tryin to avoid responsibility for the accident.

Then again, i am Canadian by nationality and its where i grew up so my views are a bit different. Sorry if i offended :)

And at the moment, there is absolutely no indication that he is driving without insurance. Everyone is so quick to jump to conclusions. You cannot assume that the guy does not have insurance just because he was going to drive off.


If you read the thread properly you will see that no-one has jumped to any conclusions except you.

Concerns were expressed that he may be uninsured because of his behaviour after the incident. The OP has been advised to check and to report it to the Police if it's found to be the case. That is all.

An he also said he had phones his insurance. He has already them aware of the incident now, so his premium will be going up wether he claims or not even tho it's not his fault!

Let insurance know he was trying to leave the scene of an accident when u manage to stop him!
Sounds like he isn't insured.

I took it from this. And your comment in response to Dan.

The OP doesn't need to be advised to check- he doesn't need to worry about it. Give all the details to the insurance company and they will do it all for you. It's their job.

I didn't jump to any conclusions.

I would say if he was just driving off, he did a pretty crap job of it. The guys workmate had enough time to run in, find him, come out again in time to find the guy. I may be wrong about this and it may be a huge car park or something I don't know. I would also say there are a high number of people who would have driven off after something like that - not because they do not have insurance (although more and more people don't >_<) but because the country seems to be going down the route of no one accepting any responsibility for anything.

But as frustrating as it is, its still only a car park shunt - it happens all the time. Should it be any more upsetting because of the car that you own?

Yeah that bit sucks. Something needs to be done about that from a legal perspective - but that does not mean he shouldn't report it to the insurance company. The other guy clearly wasn't going to settle privately, so the OP has to decide is the increase in premium worth the recovery of the money for the repair? I would suggest probably not, but if the other guy does report it to his insurance, he is screwed either way.

Not sure of your age or policy but if young and already paying a fortune its a shame you rang your insurance company, I would of given it 24hrs then rang the guy directly once both parties had cooled down and tried to sort it without involving them at all.

Now you have rung, you may aswell go the full hog, give details and let them handle it

This really annoys me about insurance, through no fault of your own you get penalised financially >_<

He actually has 90 days to decide wether to claim or not. I advised him to check as I got hit my an uninsured driver and it took the insurance company 2.5 years to work that out!!!!
I had a lot of grief from the person who hit me as he blamed me for being a young driver, even tho he hit me up the arse!
Said insurance company would have me as was my fault and all the usual scare tactics. Even tried to make me pay for his car. I just laughed an told him I'd go insurance. People like that find any excuse that YOUR car Wont pay out. They said i wouldn't be covered because I had tinted eindows and alloy wheels on my car. So again I laughed and told him everything was declared!
Turned out his car also had fake plates on! But he changed his story about 6 times to insurance company. That he wasn't even there. Then he reversed into me. Then there were 4 passengers in his corsa 2 seater van that were injured from me reversing info him on a main 60mph road!

I am only offering this advice as I've been in the worst case scenario regarding insurance claims before n it is a pain in the arse. If u can find out yourself there insured its piece of mind for yourself that you won't loose your no claims or loose out at all.

First thing is to consider if there's enough damage to warrant the likely hike in next year's insurance premium if they're involved - get some renewal quotes with & without a bump. Afraid it sounds like one you might end up taking on the chin; if you do go after him report it to the police, if he didn't give you his insurance details - better still get your mate to give them a statement. As Dan said, they won't usually be interested, but it may help if he gets awkward. Take some photos, preferably before you move your car.

You could be uninsured, untaxed, and driving while off your head on White Lightning, he'd still be liable if he caused the damage.

Perhaps I deserve a flaming for adding this, but if he has phoned his insurers and it turns out to not be worth his while he could always say he was mistaken & that it was a wind up by his friends - if asked. I doubt it will be recorded on the basis of one phone call, especially if it was to his brokers rather than the actual insurers. There could even be an argument over what's an accident and what's wear & tear.

when it's time to get your mini repaired don't use the insurance company bodge artists body shop

find your self someone that is used to restoring minis or at least classic cars and get then to do the work

Minimartin - fair enough. The inefficiency of insurance companies astounds me. Fortunately, I have had no problems with mine.

rant over i was angry today (as you can tell) and this has hapeened to friends and nearly me so i got annoyed :D

lol well depends what insurance company you are with because admiral, elephant and diamond will charge you more even if you werent in the car. but if its just a scratch then it wont cost that much and try and get the other guy to pay out of his pocket. insurance companys are a right pain in the backside to deal with. and the guy will try and say it wasnt his fault and it'll take months before anything happens. but if he's being a loser than just stay calm but dont give up!
