ive read the new mot checks they do on the hid lights and to me it reads that they only fail if the wash and levelers are defective or inoperative (not that you have to have them?

I forgot about the levellers, but they are equally essential, possibly even more so than the washers. If they are not there, the MOT will treat them as not working, and the result can only be a fail. In any case there will be an offence under the Construction and Use Regulations for causing dazzle.

"In Europe and the many non-European countries applying ECE Regulations, even HID headlamps designed as such must be equipped with lens cleaning and automatic self-leveling systems, except on motorcycles. [33] These systems are usually absent on vehicles not originally equipped with HID lamps."

Taken from the following link,is a good read.

MOT changes as of this year

Headlight requirements are updated to take account of the particular characteristics of High Intensity Discharge (HID) lamps.

HID headlights can cause dazzle if they are dirty or aimed too high so car manufacturers must fit headlamp cleaning and levelling systems. A car will fail if a mandatory headlamp cleaning or levelling system is missing, doesn't work or is obviously defective.

Vehicles fitted with aftermarket HID systems must also be fitted with properly working washer and levelling systems.
