The mot has run out on my son's mini. The insurance has also ran out but he has renewed. The tax is paid monthly.

So the question is now that the mot has expired will the dvla still take the tax out each month without a new MOT? Or do they automatically not tax it or take payments?

The reason for asking is more curiosity as he has no intent to drive it except for booking it in for the mot. And he's debating whether to cancel the insurance until it's got an mot.

Normally I would have helped him do the bits to get it through the mot by now but wifey has decided to cash in in her tolerance of our mini habit and has demanded enormous amounts of work on the garden!

I would guess the DVLA won’t continue to check the MOT and just take the money. As above, just cancel the tax, SORN it and leave insurance.

My son just ran into this same situation with his VW golf which the mot ran out (he cancelled the insurance but forgot (!) to SORN - after three months the DVLA wrote to him to "warn" him that he shouldn't be using the car and needed to do something WRT to the tax (SORN it or get an MoT)

You're asking if the DVLA will take & keep your money unless you stop them  O_O

Is it kept on private land?

In which case it needs to be SORNed, or a punishable offence is being committed.

Is it kept on the road?

In which case it needs an MOT or, if it's more than forty years old a signed declaration that it does not need one, to be "Taxed" (VED Paid), or a punishable offence is being committed, on top of which the vehicle can be legally removed and crushed.

Your call?

Cool, thanks that clarifies things. It is kept off the road, so sorn it is. So effectively because it has to be sorn it cant be taxed, whether the direct debit goes out it not.
