What age is the car? If the seatbelts were OE when the car was made, then it's probably new enough to require rear seatbelts. Not having easy access to thre rear seats doesn't negate the need for the belts really (IIRC).

you can register the car as a two seater though and then surely nothing will be tested in the rear?

I believe if there are no rear seats in the car then it does not need rear seat belts. But, I believe this also means that you will not be allowed to carry more than two passengers (in the front) until you have your car re-MOTed with the rear seats and belts in place.

No they won't. All cars first used after 31 March 1987 must have seatbelts for every forward facing rear seat that is fitted. Black and white. Removing the rear seatbelts is more than an MOT fail, it's a breach of the Motor Vehicles Construction and Use regulations, punishable under section 42 of the Road Traffic Act by a maximum £1000.00 fine. If you get pulled with rear seats without belts and the Police notice it will cost you.

Lots of cars have side or rear facing rear seats. Land Rovers, Volvos with seats in the boot etc. The law's been changed since then too and now pretty much everything with less than 8 seats needs belts in all positions.

Sadly, I remember riding around in cars before the ruling and nobody every thought any different, you just got in and sat down.


Pah, when I were a lad...........

You didn't even have seatbelts fitted, and crash helmets on bikes were only worn by the police!!

Sorry to go offtopic, but just fitted harnesses to mine.

Its a 80/81 car and never came with rear belts.

The front harnesses are bolted to the rear seat.

I have the rear seat in, but it is not accessible.

Am I breaking the law?

Hi,

If it's any help my integrale passed an MOT a few weeks ago: I'd removed the back seats and the belts. I did a bit of research before taking them out and think the consensus was that if there's no seats, no belts are required.

You might be able to get away removing the cushion and backrest (6 screws: not a big job) although the bench bit built into the chassis kind of complicates the issue i guess!

Could try ringing the garage?

i have taken out the back seat and bench (foam part) and the seat belts, and my car passed the mot like this
