two answers to this question.
Make sure they are testing it on the correct test, if its carb, make sure they do the basic emissions test (BET) on it, it shouldnt be a problem getting it to pass without a cat. If its injection, make sure the injection system is operating correctly and refit the cat.

Mini Tahiti LE should have a HIF38 carb I believe?
So just tell the MOT tester to check the information at the back of their guide book, because it states that no carburettor equipped Mini needs to retain or have a cat fitted and the emissions shouldn't be quite so strict either. Well less than for an injection equipped model anyway.
If you had the MOT done at Kwik Fit, then you may want to go elsewhere.

My 1994 Sprite has a HIF38 carb on it too. When I got it MOT'd by the local council (cheaper than elsewhere) it initially had to be under 0.2 % in the emissions test! Which was obviously wrong. After putting in the (almost) exact year and model of the car this went up to 3.5%. I failed first time with an average of 5.8% (It went from 3.8 to 7%) but after getting it rolling roaded I passed with a steady 1.2%.
Anyway thats not the point. My car was tested as a "non-catalyst equipped" vehicle, or similar, even though they knew it had a cat on it. So I could have probably removed the cat and still got an MOT.
If it keeps failing on emissions you could try what I did and get it set-up properly on a rolling road. Mine cost £65 increased the power and reduced emissions, so everybody wins
