well when questioning the mot fella.. he said it doesnt need to work when pressed.. but should light up when level is low...
but they have no way of testing that surely?

Shorely (sp) if it doesnt work when pressed, then it wont work when the fluid level is low?
Mine doesnt work, because one of the terminals had corroded off, and it just passed an MOT...

If you remove the cap with the two wires still connected or to test the circuit press down the button in the centre of the master cylinder cap, both of which you should see that the brake test switch lights up.

Yeah they can just take out the brake fluid which should make the float go down inside the cap which in turn should activate the light.
In either case I'd strongly advise to keep it and repair it. What if you're on a long journey and you're losing brake fluid, how will you be able to tell? You could end up wrapped around a tree. I know it sounds harsh but it is there for a reason like 1984mini25 said.
