Alright lads,
Parked my car up a road where i normaly do this morning to go to college. Come back and its fu**ing gone! Phone the old bill and its been taken to a local recovery place, so i get their number and go and pick it up. Their charge was £105.00! when i get the car back, i find a ticket on the window which is a parking ticket for another £30.00

The car was parked just slightly in front of a garage (marked in red) which has no 'no parking' sign on the door and neither does it have a droped curb to the enterance. However the ajoining garage does have a 'no parking' sign and also has a droped curb to its enterance.

My question to you guys is basicaly where do i stand as to appealing? Do you think iv got a case?

I would say based on logic and basic understanding that that is way out of order! As you wasnt obstructing a driveway it was a bit harsh, and they will argue you blocked a garage but i thought it was only concerning lowered curbs! The owner could argue that he/she couldnt afford the costs to lower the curb (a rip off in itself) so had to leave it high and you still blocked it, but as it wasnt signed and assuming there are no road markings/signs on lamposts i'd say its worth a try!

i used to get people blocking my drive all the time and was forever phoning the police to get them removed

does it state that it was towed for being parked in front of the garage or have they changed the parking restrictions in the road. they do this overnight and without notifying people and there is nothing you can do about it if this is what happened.

IT is not illegal to block a driveway providing there are no cars/motor vehicles in that driveway that might need to get out. IF there are none in the drive then there is nothing that can be done, providing there are not parking restrictions. Great for upsetting people

i used to get about 6 cars a year moved for blocking my drive

i found out 1 was a off duty traffic cop

I live in Plymouth and we get people parking in front of our drive all the time. We have to get the Police to move them. > What we do some times when we can is Park a car either side of the the parked car as close as possible. Then we sit in the garden with a nice cup of tea and watch the driver of the car get P:xxx:d off because He/she cant get out with the car.

If you were blocking that garage then you got what you deserved

Also you were blocking those steps in case three minis loaded with gold bullion wanted to come down them

my understanding is that the local council has to have clear signage, as does the owner of the property stating times and days which you can park their if at all. This also applies by markings on the road. Though i am asuming you have got your car back?? go to the citizen advice.

you need a sign to say that there's a garage there and people park car's in garages ?

some of it is a bit stupid, its as bad as the law that can get you locked up for leaving traps that burglers can hurt themselves with.

Judging by the size of the space and the fact it's a Mini, if the owner of the garage couldn't get access to it, I must say he is a tool.

You're totally right there. You can't block anyone IN but theres no restriction to block them OUT of the drive.

Obviously the police have used their discretion, the owner of that garage must've kicked up a right fuss about it.

My parents are in a similar dispute where next doors have had a new drive and white lines added to the road which actually venture onto 'their' side of the property boundary but leaving literally 2 foot to park in between the next white lines protecting their driveway. Dad has spoken to the highways dept who say that white lines (H or T bars) are advisory lines not legal restrictions.

Anyway in this case there's no lines, no signs in place to say you aren't allowed to park and I wouldn't say you've parked irresponsibly so I think it's bang out of order.

Some people just don't like others parking adjacent to or even anywhere near their property which is a shame really, they should go find better things to do!

My advice would be to get a massive concrete block from somewhere and put that in front of their garage door in the middle of the night, teach the fussy a lesson.

Not that im saying you would, but if you do appeal and are successful etc, i wouldnt suggest you park there again as you may find a few flat tyres/scratches if the owner is rather 'upset' about it..
