On the fact that you were going to get a pass to put in the car and that you have legitimate access to said pass, I can't think for one moment that they could defend their actions, on top of what paul said about contract law etc...
If you fill in the form and make sure that the claim is very comprehensively written out then there is a likely hood that they will pay up in anycase rather then risk it.
There is also the chance that they may not even try to defend it and then you could apply for summary judgement.
Chances are that you wouldn't even have to go to the court.

There must be some sorta time limit they have to give before towing away a car to give you time to collect the permit or obtain a pay and display ticket ?
I'm pretty sure that you're entitled to ten minutes, to go get a ticket.

I know that its a bit late now, but if it happens again before you talk to the people towing it away go and sit in your car straight away. They can not tow it away with you in the car as you are not insured, and its against health and safety. Tey call the police, you show the police your permit and the gys towing get done for wasting police time.
