well thats stupid and confusing. but you cant weld to rust anyway, so surely whoever repairs it is going to have to take back the rust in that area as far back as fresh steel so they can weld a replacement panel or whatever in.The rust may be a problem. I was told by a garage that when they are working on insurance claims, they 'can not improve the damaged area, it has to be returned to the condition it was before the incident'. Which means, that should it need a new panel, they have to put some rust on it, or should they be able to hammer it out, they can't make the rusted area any worse than it is already, which they no doubt will do if they are hitting rust with a hammer!

It is stupid and it is confusing, heck it is insurance after all! I was lucky enough to be able to settle my claim out of the insurance in the end with the other party admitting full fault

Or bodge it that could mean it’s unsafe, which were that bit of rust is, as it’s within the prescribed area of a structural mounting would fail the mot. Although most of it would have been covered by the wheel arch and out of sight, so would have passed.

my driving instructor told me when i was learning to drive that if you reverse out of a driveway, onto a main road, and you hit someone you are at fault no matter what. unfortunatly when i made a calim a few months back my clubman got written off Cat B because of the rust on the rear seams and tatty paint, they said it was beond ecenomic repair or something daft like that. id see if you can get a couple of quotes off bodywork people so you have an idea of what it'l cost.
when the insurance came to look at mine they said it would cost £5200 to change the roof and repair the rear quarter which i didnt think was right but the car was only insured for £2500 so they wrote it off.

Been on and off the phone to both insurance companies and they have both said its his fault, and now either his company will pay a garage to fix it, or give me an agreed amount for the damage. But they said they wont write it off as the damage isn't that bad and its a classic. So going to get quotes tomorrow, so I can show them how much it might be.
