Hey guys.

Thinking about it, is it legal to put a 1380 engine in a 99 Cooper? If its a carb engine and that was an MPI car would it fail an MOT?

You'll need to keep a CAT on it to have any hope of passing the emissions.

What are you doing about the wiring loom/ECU?

If you do find a way to put the 1380 in there, at 19, just passed my test I insured a 1425 for £2k. If your not prepared to pay that sort of premium then walk away now, as I doubt you'll find much cheaper.
