The woman from across the road reversed into my MG ZR160 exactly one month ago and her husband stated infront of witnesses that he doesnt want to go through insurance as it will affect her 2 years no-claims bonus.

He said for me to get quotes, which i have. One from a repair centre, one from his mates bodyshop and one from my mates bodyshop. My mates came in cheapest, more than £200 cheaper than the others.

I informed him of the prices and he said he'd talk to his mate and get back to me. Over a week later i'd still heard nothing so tonight i went over.

He now claims he wants to go through insurance and that it wont affect my future insurance, which i believe is untrue.

Can he honestly go through insurance considering its been a month since it happened and he hasnt reported it to his insurance yet? He wants me to say it happened at the weekend yet i have a crime reference number stating Feb 10th 2010. I only got the reference number because when i went out to the car i saw it was damaged but no note had been left so thought i'd need it for my insurance. His wife denied it at first when challenged but later on during the day it happened she amitted doing it.

Just where do i stand?

if she has admitted liability it wont affect your insurance at all. just tell your insurance company that it has taken untill now for her to come forward and admit it. i am pretty sure there isnt a time limit to make a claim.

Ring your insurance company (unless you have already), that's why we have car insurance. As their to blame, then it really shouldn't affect your policy and you'll not lose your NCB.

If they are admitting blame, then you can't really ask for much more.

The two things that really bother me are that when my mum was hit by another driver she had to pay out the excess first (which for me is £350 and i cant afford it) and then was paid back 3 weeks later. Also she has had to put it on every quote for the last 4 years, even though its stated not her fault, there is a £60 difference on her premium each year compared to not declaring it. Considering her insurance is only £200 including the £60, thats quite a difference for something thats stated and agreed not her fault.

I've just read through the T&C's of my policy and two others. It states that incidents have to be reported within 48hrs. Does this mean he cant go through insurance now?

Could i get him to pay up by stating she left the scene of an accident without leaving any details, which is technically illegal?

If it's his fault, your insurance shouldn't be affected. If you have to have courtesy car, repairs for your MG, his insurance suffers.

Not yours.

Dont they always ask when you insure a car if you have any claims or convictions in the last 5 years NON fault or not?

You keep thinking that mate, Insurance companies will do anything to rip you off. Someone drove into my car (another ZR as it happens) while driving along. Luckily there was no damage to mine but it ended up being a 50/50. About 2 weeks later my policy was up for renewal, guy on the phone obviously knew about the accident, told me as there was no damage to my car and i hadn't claimed for anything then my premium would be unaffected. My reply was ( I had the renewal quote in my hand at the time)

If it doesn't affect my premium how come he renewal is £200 more than last year.
As you can guess I didn't renew with them.

I think you should tell the bloke that his wife left the scene and if he does not pay to get it repaired then you will be visiting the police. Would also advise taking a third party witness to hear her say she did it, as my old insurance company would not let my fiance be a witness.

Stand? In a pretty good effing position actually!

Whether you have not reported it straightaway to the insurance company is not an issue, they get it all the time while things like this are being sorted between the individuals, but as you have a crime ref no' from the offence date your in the clear whichever way you look at it?

Just tell them (idiots across the road) nicely you have informed your insurance company and they asked for the crime ref no' as you reported it at the time to them as there was no note or anything left on the car and are proceeding that way and its all going through now.

The guy is a messer so dont do him any favours, people need to learn. And don't say you have a witness to the insurance company (people do in a dispute) as you have a police report to show you dont know what happened at the time.

Your premium will fluctuate regardless of this, welcome to insurance.

I would'nt agree to any other time than when the bump happened. They might be able to prove they were somewhere else by changing the date.
