why wouldn't you go through your insurance ?

it's what you pay them to do and they are there to sort this type of problem out

you won't loose any no claims bonus as they will claim any money off the other persons insurance

I've been told of others who have not had agreed value on other cars they have disputed the offer given by the insurance and got more off them. Is that possible, as you can find adds everywhere for minis worth allot more than £400.

Youve heard why you should go through insurance but if he agrees to get it repaired at a proper place it could save it becoming a
cat c or d write off on the log book so not worth as much (if/when you come to sell) also you may not loose your no claims but you will have a premium hike as youve still made a claim.

I guess it depends how good of an example your mini is too at the end of the day

I have a hand written receipt of what I payed. Plus receipts for all the work I've done to get it to pass mot plus other extra work!

My advise would be to go through your insurance. The person who hit you probably thinks it's on old Mini and wont cost much to fix. I'd be suprised if it's less than a grand. So he'll change his mind once he sees the quote. It goes without saying don't let the insurance company take your car. Arrange for them to inspect it at your house/work etc.. If insurance writes it off never take their first offer, be prepared to refuse a few times, they will always improve the offer. Then buy the car back and fix yourself or arrange a garage to fix it.

Also there could be damage you are unaware of such as bent subframe, tracking out etc.. all of which will add to the cost.

Only downside to going through insurance is this will see an increase in your premium at renewal as your insurance will see you as an increased risk. You will have to decare a 'not at fault' claim for the next 5 years also :-( It shouldn't be a huge increase and you can normally absorb some of it by shopping around.

Also as the days been progressing my necks been getting stiff and starting to get sore as is my back. going to doctor for this tomorrow told my manager who said i should do a injury claim for this, but would i be able to if we sort this between ourselves?


A defence layer would argue that if you were really hurt you would have gone to doctor today, and you've only decided to see a doctor a full day later because your thinking no win no fee, you've admitted as much on a public forum - not a smart move really mate
Claim for your repairs through your insurance, if they write it off buy it back off of them.

Firstly its not illegal to sort out minor claims between the parties involved, the insurance is there to indemnify you if you can't or don't want to, but you don't have to use it.

The other and more important issue is that a whiplash injury can take time to develop into pain as the swelling and shock can hide these effects for a while. Get down to your GP asap to get it checked out and recorded in your medical notes though in terms of treatment its unlikely they will do anything apart from recommend pain relief which you can buy yourself cheaper than prescription.

Notify your insurance asap never feel pressured by the third party into accepting his solution, its sounds like an easy non fault accident and you should be confident and clear that it was not your fault, after all you stopped for the lights, he didn't!

The agreed value is between you and your insurer, not the 3rd parties insurer, they will only pay market value, and that is only if its written off - they might decide to fix it. Arm yourself with information on what it would cost to replace your car with a similar one so cut out some ads from Mini World, Mini Mag and ebay classifieds so when it comes to arguing the case for repair with the loss adjuster that you are able to provide this information quickly and you will either get it fixed or at least a fairer settlement than if you hadn't done your homework.

Claiming for the injury could take a long time, you would certainly have to be assessed by an independent doctor paid for by the insurance company, and they might also pay for physio etc to reduce the healing time which is good obviously.

I strongly recommend you don't take any chances, you only get one back and pair of shoulders, so do it all properly, and remember you're the innocent party in all this.

the question they will ask is have you been involved in and accidents in the last 12 months

you will have to answer yes if you use your insurance company or sort it out privately beet the 2 of you

you have still been involved in and accident
