put simply

your unladen weight of tow car has to be more than fully laden wieght of trailer ie
tow car = 1300kg unladen
trailer weighs=1299kg fully laden

AND the FULLY laden GROSS weight of tow car+fully laden weight of trailer doesnot exceed 3500kg

That's how I read it too, though it would appear they have changed the rules from 1st jan this year to mean you can't tow anything over 750kg full stop

That's only for people passing their test this year.

youll be hard pressed to find a car transporter trailer weighted under 1300kg tho, done loads of reasearch on this thru the smmt!

yoir best tow car would be a 2.0diesel focus 05-on

What if the trailer doesn't have a MAM plate (i.e. homebuilt). Would they just take you to weighbridge and check the trailer and contents don't exceed the weight you are allowed to tow?

Found some info, trailers without a mam plate are rated on the total load rating of the tyres, so if it had 4 tyres all rated to 200kg it would be considered to have a MAM of 800kg

most likely or you can just downplate it yourself according to the smmt, the tyres on the trailer have a code on them stating how much weight they can take max (google it)

Yes, once weighed, depending on the weight, you would be fined, the trailer and its contents recovered by the police to the nearest storage facility (usually the police contractors recovery yard). You would then have to provide evidence to the police station to release the trailer (usually drivers license of someone who can tow the trailer, insurance for that person, a suitable vehicle). Subject to all that been correct, you would then be allowed to go get your trailer back, subject to paying the recovery firm the recovery fee (about £150) plus any storage costs (£20 a day say).
