Yep well registration and ownership are not the same, again a baliff would do the nessessary checks to find out who the car belongs to, who pays finance etc etc. He could have sold the car for £1 !!

Its unlikely hes getting all cash in hand, if that is the case, report this to DWP asap, as they will want to know why hes not paying PAYE, they will either have to fire him or put him on the books.

exactly... thought about going the other route of saying his sister is the main driver and proving shes not.. but hard as well.

and then i could get them to do an attachment of earnings.

As it stands youve done everything i can see within your power, now its up to the debt collectors. If he owes you money you have to pursue it through the court but you might be waiting a long time.

You might have to chalk this one up to experience

i aint letting the little sod get away with that much money...

it just aint happening.. even if i have to mug him every payday until its repaid :lol:

2. i dont like blood
3. your a *baby cat*.. lol!

i think my best port of call is to just pay the debt for the council tax.. and take him to the small claims court.

I'll say it so imabitnaughtyxx doesn't have to, but imagine a County Court Recorder would say the same: Why did you let him get in to the situation of owing you that much in the first place?

Just making the point so don't feel the need of explaining Matt. Not chucking him out on the street isn't something I'd hold against you :lol:

well yes there is that... i paid him money for rent, bills etc.. and he didnt pay them..

he then did a runner..

so i had to repay the debt

the council tax is the only thing i only paid half of... and thats come back with me being liable unless i can prove where he lives.

If the council tax is in your name soley, not joint names, regardless of blame you owe the money and before you get a CcJ and baliffs, which will cost even more, i would pay the money.

Thanks ethel, i didnt want to state the obvious as i was only giving factual advice not addressing my personal feelings on the matter, but for the record, yes it was a tad naive.

its not, its joint.. and the council tax doesnt work like that anymore...
your black listed against council tax.. but not credit history..

and ive been informed that i should sit it out by the council tax people as i can prove ive paid half..

Thats not quite the case, if you default thats one thing but if you are taken to court for non payment its still a judgement and is on file even though you might not see it on your credit history. Non payment will create a warrant eventually which will deliver those baliffs, they take 4 times the value of the debt in goods to allow for auction house prices.
If you need any more advice i will be back later possibly or tomorrow. I have some law notes i can flick through as well.
