This is all a bit confusing.

I don't think the cancelling the insurance is that much of an issue. The car was covered at the time of the accident and claiming through his own insurance was never going to be way forward anyway. Although I'm fairly sure the penalty clauses which apply for early cancellation he's probably gained very little - perhaps a few pence - in doing so.

Sorry to say, but the biggest fool in this is your Dad. What on earth was he thinking? Cancelling the insurance, not great by recoverable, but agreeing to £500 without getting it assessed is borderline insanity!

I'm guessing there's some insurance fronting going on here which is why the folks are involved.

but i thought it was always best to use "your" insurance to talk to "their" insurance so the legal side was all above board, no ???

Well they still are his insurance company as the contract was in force when the smash happened.

Bit like if you were to have to make a claim on short term insurance.

Edit: They might well tell him to spin on it for not notifying them I suppose. In that he spoke to them, cancelled without mentioning it, then made a claim and tried to get them to sort it

In the eyes of the insurance company and also the law, he is to blame. He should not have been travelling so close to you (it could be seen as tail gating) - also, if you go into someones ar*e, its 99% your fault.

Definatly a lesson to be learn't.

Make him pay. Just because its your mate dont loose your mini.

I agree with this & all the above comments

If he was a decent enough mate, he would bloody well stump up the proper amount of cash, or offer for you to claim off his insurance as it was HIS FAULT!!

Friend or not, make the claim because in many years time when he's laughing about the fact he had one over on you and you're then kicking yourself for not taking him to the cleaners, you'll be the one who loses out.

If he was any kind of friend then he would pay up for the repair in full, every last penny.

So just phone your insurance company and make the claim and don't be influenced by anyone, not even your dad as it's your Mini after all.

Anyway you'll have loads more friends since you own the best car in the world. Much better friends in fact and not the kind who rear end you and try to wangle out of it by involving their dad.

On the plus side am i the only one thinking i would like to buy it?
I live in notts and would be able to give you an idea if its repairable .Or i would buy it off you .

I bagsied the spot lights and loom last night! >_<

Considering the plates arnt legal, im pretty sure the insurance company would try and wiggle out of it, because the car technicly wasnt road legal at the time? - just a thought?

Sorry mate, it has to be said - Stop being weak, man up to your mate and get him to stump up for the full repair. This is not on, you're letting him off very lightly and he's treating you like a doormat.

the worst part of this whole situation is the fact that a good, rust free, mini is going to get scrapped unless you fight to get it repaired fully and properly.

a rust free mini is a rare sight!

I thought it was 1st April 73.....lol whops I've started another arguement.

Yer thats it just checked the topic >_<

It has to be made before 1st January 1973 but cars registered up until 1st April 1973 are permitted because they were likely built in 1972.

And remember to remove the illegal number plates before anyone comes around to look at it!

O.M.G. You are a moron. 9 pages of advice... people should just let you suffer now. I cannot believe you cancelled your insurance or took 500knicker in the first place. Sorry but you are a complete ninkempoop who deserves to learn the hard way.
