Request for information form DVLA V888 if you have a good reason:
http://www.direct.go...t/dg_065303.pdf

With V62 form the previous listed owner will be contacted by DVLA, if no reply from them in 2 weeks or so the V5 will be sent to you.............but if owner reappears later there could be a problem under civil law over ownership.

You still need to own the vehicle, getting a V5 for it doesn't entitle you to take (steal) it!!

Call the DVLA, there is (or at least used to be) a "claiming an abandoned vehicle" process (provided this is the case with the Mini). Someone did do it on the Moggy forum, but the car was on a public road, MOTless, taxless so liable to numerous fines etc. The vehicle was theirs within 8-10 weeks. If the previous owner comes back in years to come and you can prove via Police (check to make sure the car isn't stolen etc) and DVLA communication that you tried to contact the registered keeper beyond reasonable doubt. They don't have a case. Removing it off the land though, will need permission in itself.

Use this form to apply for a vehicle registration certifi cate (V5C):
• if you have bought the vehicle but have not received the V5C in your
name, or
• because the original has been lost, stolen, damaged or destroyed.
If you have previously had a V5C in your name for this vehicle, and there
is no change to the vehicle or your personal details, you can apply for a
duplicate by phoning 0300 790 6802. If you are deaf or hard of hearing and
have a textphone, phone 0300 123 1279. (This number will not respond
to ordinary phones.) Please have a debit card or credit card to hand when
you phone, as you may have to pay the £25 fee (see section D).

this does not say you can use this form to steal a car from the owner,

this has come up before on the forum. you cannot go onto private land, go into a private barn and remove some ones goods.
regards dvla contacting the redg owner and them not replying in a couple of weeks they will give you the vehicle, this is not coverd by the above as this is for a buyer who has not recieved the v5c or it has been lost or destroyed or stolen, what if the owner is abroad/ in prison/ in hospital etc for weeks or months or years, dvla will just give you the v5c, i dont think so.

if it is fine to enter private land and enter a private building and take goods then i think all burgulars and the rioters who stole should all be released from prison or given back the fines etc.
what makes people think they have a right to take some one elses car just because they want it?

I had someone apply for the log book for my bike which was kept at a garage at my mums due to me not being able to ride for medical reasons. They thought because it was covered in dust sitting in the garage for 3 years they could just apply for the V5, get in the garage and take it. They did feel very stupid when the police arrived on their doorstep with a warrant to reclaim it.

The above pretty much hits the nail on the head.

If you do manage to get the V5 for the car you still dont own it.

You then go and remove the car, owner contacts the police and you get arrested for theft!

some posters have said to ask the council who owns the barn, the council can only tell you if they own the land, they dont have records of land ownership.
the people to contact are the local land redgistry office, they have the records of land ownership if the land is redgested, all land belongs to some one but it was not compulsary to redgester land untill some time in the eightes when you took over ownership.

I'm currently in a legal battle regarding the scamps plate.

Some toe-rag applied for the V5, the DVLA contacted me and i stated i still had the vehicle and yet a month later they still gave them a V5 for the registration. The police are now involved as to why they felt they could claim it.

Please dont put the owner through the hassle i'm having, and you may find yourself in trouble with the law/dvla for the claim.

So the DVLA obviously didn't listen to you lol. Every dealing I have ever had with the DVLA has been a bad experience. Will be interesting to hear how you get on with this one. I hope it all works out for you

Couldn't agree more, its tantamount to theft.

Didn't someone do this before and spent loads of money fixing it up and then the owner came and reclaimed it?

He had spent like £3,000 on it so the original owner got a restored mini for free basically.

If I were you I would go by the book and be patient. Better safe than sorry! :)

Is there a house nearby? A barn would be part of a farm and the farm house is never far away.
