Many many thanks - I have his official address (electoral roll public info) which is the same he gave me at the start, I found out that he seems to be residing to another address but do not have the precise postal address (i.e. with street number etc) & where he is "trading" would be most useful... what a community on this forum! =)

they found ALL of the details about a bloke that stole £40k worth of snap-on tools!

It certainly sounds like a police matter, it might also be worth talking to your bank if you paid money to someone and it was paid into someone else's account. I can only guess they have the same name, but it would be very hard not to consider it theft or fraud if the account holder can't offer a reasonable explanation of why they are in possession of your money.

It's a little more complicated plus, unless you report within a certain amount of time I'm not sure how this would work! Banks tend to deal with immediate fraud! But it's still worth looking into because he has stole my money

Not sure about the criminal case - or at least my lawyer has not pickd it up...just asked her legal opinion on this & will report...will report once I can find time to call the police to report them (in my case Carl is also involved...eveen if everyone knows James was the real issue)...I will update as soon as I know more!

The downside with a criminal case is that it would take precedence so everything else will have to wait, not that it sounds like you'll be getting your money back in a hurry anyway. It might be good leverage though, fraud & theft are all about intent, if you didn't intend to rip someone off then remedying it is a good way of proving it. There's no time limitation on criminal acts, if the money is still in the account the bank could be aiding and abetting to let it be withdrawn if they had reasonable grounds to believe it wasn't the account holder's.

If you have proof it was paid into his old's account, I don't think there'd be any difficulty in obtaining a freezing order as long as they aren't that hard up to need it to pay the gas bill etc.

courts can issue confiscation orders, and set up payment plans to victims

Well he's not settled for the reasonable amount I offered, so be it, I'll see him and his father in court, I will also be pushing forward with the other issues my solicitor has suggested! This isn't just about my money he's taken it's about right and wrong. I won't be letting this go! All I have is time and I intend to use it to the fullest

Luckily I have had no personal dealings with this outfit and am really sorry for those of you who have. How big a premises were they operating from? Surely there must be someone from the thousands of members on here living local? Can no-one swing by to check on the number of cars on site? I live in Leicester, a bit far for me to travel but I know people who may be able to drive past. Where is it?
