Scrap Car On Private Land - Law?

Hello. I know there are a few legally minded people on here. Basically, where I live there is a bunch of garages and a small car park which is the only private parking provision away from the road. One and a half spaces is taken up by an old VW Polo which hasn't moved in years. It's covered in moss.

 

As this is private land, and the owner has ignored various signs put on the car begging them to move it (and giving them numbers of people who will move it for free) is there anyway we - the residents - can get it removed?

 

I don't know which house the owner lives in but word has it they are very old and possibly mentally not in the best condition. However we are extremely short of spaces, like everywhere, and want this thing removed! It would make a great donor car.

 

Does anyone know if the council have any powers e.g. on environmental grounds?

If it is private land then the council are generally not interested, you say it is private land, is it private in that it is owned by the individual residents ie mortgaged property or is it owned by a housing association/private landlord. If so then they will be able to do something. If it is private as in owned by individual mortgaged tenants then generally there is nothing the council can do if the vehicle is SORNed. If they are causing a hazard or obstruction, other than preventing more beneficial use of the parking space the environmental section of the council may be able to make an approach to the owner.

is it parked on his land or someone else's?

Is the land owned by the individual who's car is on it, if not maybe discuss it with the land owner. If its over two spaces personally I would jack it up and move it myself. If the owner has not touched it then your not being unreasonable. If not try phoning the council and report it as abandoned.

phone the council and tell them you have seen rats in it / near it, it will be gone within the week.

It's private land in that the freehold is equally owned by the 28 residents, including me, who live there. So not a housing association.

 

It's not causing an obstruction although it isn't in a designated parking space, it's at the side of the entrance but lots of people park along the lane there.

 

I'll check if it's SORNed. I expect it is. I'm not torching it!

Even though it is not being used doesn't he have a right to have a vehicle stored there?

Maybe move it to a place out of the way of everyone else?

It may be daft and he's not going to do anything with it but it's still his property and he doesn't want to get rid of it for some reason or another...

The DVLA will release the car owners name if you (and your neighbours) have good reason like in the case of an abandoned car.......there is a special form (V888) to apply for the details that can be downloaded. This would then at least confirm who you are dealing with.

"The V888 application form is for people who want to apply for information about a specific vehicle from DVLA. They need to show ‘reasonable cause’ for wanting this information released from DVLA records. This means they will have to provide details of why they want the information and how it will be used."

Yes a perfect right, but it's a shared space which they are taking up for no good reason so others cannot use it as intended. The car is now beyond roadworthy and unfortunately there is nowhere else nearby he could put it (unless SHOCK HORROR he puts it in his garage).

Is it SORN'd ?

 

Is there any danger to anyone caused by sharp edges where it is rusting?

 

Any fluids leaking from it which could have an environmental impact?

 

Has anyone actually spoken to him to offer assistance in disposing of it?

The only thing I would do is straighten it up into one space, it's sorned and parked on private land which this person is entitled to park their car on.

 

You might think it's scrap but it might be his pride and joy.

 

I had several minis on my drive and there were some people in the close who didn't like it, thought I should get rid of the lot

It's really not anyone's pride and joy. I won't go into details on the person but let's just say they are not community minded. The private land it's parked on is his as much as anyone else's. The difference being that others don't dump moss-covered heaps and leave them for 5 years in an already over-subscribed small area of parking.

 

I haven't personally spoken to the guy as I don't know which number he lives at, but we've all left notes on the car asking respectfully that he considers removing it - we've given him numbers of scrappers who will come and collect it for free. All have been ignored.

 

It's not been touched for years, and it's causing other people to have to park away on a different road every day. None of us have driveways and none of our properties are accessible by road. The garages and short entrance lane on which this car is parked is the only parking for 28 properties and this car was parked bang in the middle of it back in circa 2009 and hasn't moved. So you can't really blame us for trying to get it removed.
