Any news? This is crazy that this guy has your car... surely he doesn't had a valid v5, because you will have that? Bet he found out that it was stolen doing an hpi check and is trying to fob it on quick.

I would tell Ebay there is disputed title on this vehicle myself, they will pull the ad. If it changes hands in good faith twice (as in 2 people buy it one after another with no suspicion it might not be above board) then you cannot get the title back even if a court decides the clampers stole it from you.

No it was complicated. Basically, it was towed by a company. The issue I have with that is that they claim it was the company who owned the land or some crap, but I couldn't track anyone down at the time.

So when I was in touch with the company, they offered a cheaper price to release it. I phoned back the next morning and said ok, but he said that was only valid for yesterday and that the price had gone up again etc etc. So I called his bluff and said Im not paying that. I then asked what would happen, and he said that it would be scrapped if I didnt pay within a certain time. He has obviously since sold it on.

I since got a letter from the DVLA asking if I was the registered keeper. I phoned and explained the situation. They said there was nothing they could do; ownership is not confirmed by a V5 and they do not get into issues of ownership and therefore this new guy was the registered keeper.

He is now selling it. The issue I have, is the company that took the car allowed to sell it on instead of scrapping it like they told me? If they are, I have no chance of getting the mini back. If they are not, the car is technically still my property! The biggest problem is I have nowhere to put it. I am going to speak to the legal guys here for some advice tomorrow and then phone him tomorrow. I would be interested to know what he was told about the car, who he bought it from etc.

the clamping company had no rights to sell the car whatsoever, it was not their property to sell, i would just call the police and tell them that the car that was stolen from you is now for sale on ebay!

See that's what I thought. The car was taken last July. My gf went to report it stolen and it was at this point that the local police informed her it had been taken. I will get this sorted tomorrow. I am a little concerned though that if I phone the guy up, he could shift it on to someone else and I will never get it back. However, will he then be knowingly selling stolen property in that case, as I had informed him?

Fortunately the law has changed since and clamping companies cant get away with **** like this.

Its all made more complicated, being in Afghanistan at the moment.

If I get it back, it will be a real bonus.

Yes, if they even suspect it may be stolen they can't sell it in good faith. If you do this you should keep proof that you informed the seller and that they got your email in case it's ever needed (email with receipt).
