As far as I can see at worst he has incorrectly registered a car, I do agree that it is not an original 1962 car though but if you read the ad it is obvious it is not described or sold as such

He's chosen to restore the car in the manner he has, any potential buyer has as much right to be aware of the potential pitfalls.

obviously he isn't claiming that the car is the same as when it left the production line.... over the course of time, My Mini (the stealth) has had 3 different engines, a new front subframe, a new rear subframe followed by a rear beam axle, suspension changed to coil overs, new steering rack, new doors, floor pans, sills, completley customised interior, deaseamed body, the scuttle has been replaced at some point and there's no vin stamp in the gutter!!!! but it still has the same reg number!!!!!!!!!!! (which matches the vin stamp and log book your honour) do i need to lock myself up and beg to be put on a Q plate???????
Crikey Mate you haven't changed parts of your car have you? Whatever next? You can't do that because, oh wait, yes you can!!!

the shell is the vehicle, and that is what the vin plate is attached to... you may change everything else, but if you replace the shell on a vehicle it MUST be replaced with a shell of same type and of new ( un-registered ) origin to retain the registration... and the only place you can get them from now is Heritage, replace with 2nd hand it should be inspected...
There are instances like this which have been reported and investigated by the DVLA..
There are also instances of cars like this being 'crushed'.... bit of a sod if you've just paid X thousand pounds for it...
However... all this being said, you have the option not to buy the vehicle, and other people have the option to make their own mind up..

So what happens when I change the body of say a landy and keep the original chassis? Some cars I've worked on have had so many parts changed theres nothing original left. Then there's the matter of retaining no. plates on kit cars and specials that just require the cars to be built from one donor type, but not one actual vehicle and don't have the original body or chassis! There's a lot of grey to all of this!

This is true - I think this more of a stealing the ID of another car rather than stealing the actual car.

I think this poor bloke just doesnt know the rules and regs...
I have been contemplating buying a decent shell of ebay or somewhere and building a good car up with the new decent shell and my decently running gear - i wouldnt of known that you ave all these issues to contend with.
But am i getting it straight - if i have two cars - use the shell of one and the running gear off the other - as long as at the end i use the reg and log book etc from the car with the shell then i am ok? But if i use the reg and logbook from the car with the running gear then im being naughty?
In which case, it sounds like all this dude has got wrong is he shoulda advertisede as "Well its basically a 199X MPi BUT it has had everything changed to Mk1 spec" and then he shoulda used the reg from the 199X car?
Poor geezer i think he prob just doesnt know the rules and regs (OK so he shoulda found out).

In a nutshell, yes. Then all the guy has to do is transfer the reg number from the the Mk1 to the SPI so the V5 shows the details of the SPI with a cherished transfer reg number. Thats the only issue as far as I see it. The guy may or may not deserve a slating as we don't know what he's told DVLA. But he does appear to be honest and up front about how he has built the car.
In any case, this thread has been useful as its highlighted the legalities of reshelling a car - a common Mini issue.
