Thanks for the info guys, will look into it when the engine has some miles on it or if it gets worse. Got a couple of issues in the meantime :)

The plate fits against the engine block & bearing cap the gasket is compressed between them. But the plate also sits close to the gearbox and the half moon seal is partly in that gap. If the seal is too tight against the plate it could stop the gasket being compressed enough.

I think i have this problem, i changed the seal and i have still the same leak... how do i fix this problem and how do i know if the seal is to tight?

The seal can't be too tight as such. What it can be is not far enough in to the the joint between the gearbox & engine. If the leak's bad enough (it's a Mini!) and you're certain it is coming from behind the end plate - you could remove the end plate & have a look. Test fitting the plate without the gasket would show there's adequate clearance if it sits flat against the block.
